Terms of Service
These Terms of Service govern your access to and use of AccessCheck, including our website, free scan flow, hosted report links, monthly monitoring subscriptions, related emails, and any associated APIs or support communications.
By using AccessCheck, you agree to these Terms. If you do not agree, do not use the service.
1. What AccessCheck Provides
AccessCheck provides automated accessibility scanning, AI-assisted plain-English summaries, hosted reports, and optional recurring monitoring. AccessCheck is a technical risk-identification tool. It is not a law firm, legal advisor, accessibility certification body, or compliance guarantor.
2. Your Eligibility and Authority
You may use the service only if you have the legal capacity to enter into a binding agreement and you are authorized to submit the website or page you ask us to scan. You are responsible for ensuring that your use of the service does not violate contracts, laws, or third party rights.
3. Acceptable Use
- Submitting websites you do not own or are not authorized to test.
- Using the service to probe, overload, scrape, abuse, or interfere with websites, networks, or infrastructure.
- Attempting to bypass rate limits, security controls, or access restrictions.
- Using the service in violation of applicable law or to support unlawful, fraudulent, or deceptive conduct.
- Reverse engineering, copying, or reselling the service except as expressly allowed in writing.
We may suspend, rate limit, block, or terminate access if we believe you are violating these Terms or creating risk for the service or others.
4. Free Scans, Reports, and AI Output
Free scans and hosted reports are provided for informational purposes. Scan results may not identify every issue on every page, and AI-generated summaries may simplify, prioritize, or restate findings. You remain responsible for evaluating the results and deciding what corrective action to take.
AccessCheck does not guarantee that using the service will prevent lawsuits, demand letters, claims, accessibility complaints, or regulatory action.
5. Subscriptions, Billing, and Renewals
Paid monitoring is offered on a recurring subscription basis. By purchasing a subscription, you authorize us and our payment processor, Stripe, to charge the recurring subscription fee and any applicable taxes until you cancel.
Subscription management, payment updates, and cancellations may be handled through Stripe's billing portal or another billing workflow we provide. Unless otherwise stated at checkout, fees are non-refundable except where required by law.
6. Hosted Report Links and Account Security
AccessCheck may deliver hosted report links by email instead of requiring a full customer dashboard login. You are responsible for keeping those links confidential. Anyone with access to a valid link may be able to access the related report until the link expires or is revoked.
7. Third-Party Services
The service relies on third-party providers, including hosting, payment, email, browser automation, and AI providers. Availability, speed, coverage, and output may be affected by those providers. We are not responsible for outages, errors, or policy changes caused by third-party services.
8. No Legal Advice; No Warranty
AccessCheck does not provide legal advice. Communications, scan outputs, AI summaries, and recommendations are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.
9. Limitation of Liability
To the maximum extent permitted by law, AccessCheck and its operators, affiliates, contractors, and providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, business opportunity, or legal exposure arising out of or related to the service.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the service will not exceed the amount you paid to AccessCheck for the service in the 12 months preceding the event giving rise to the claim.
10. Indemnity
You agree to indemnify and hold harmless AccessCheck and its operators from claims, damages, liabilities, costs, and expenses arising out of your use of the service, your violation of these Terms, or your submission of websites or data you were not authorized to submit.
11. Changes, Suspension, and Termination
We may update, suspend, or discontinue all or part of the service at any time. We may also update these Terms from time to time by posting a revised version with a new effective date. Your continued use of the service after changes become effective constitutes acceptance of the updated Terms.
